Terms of Use
The short version
- You must be 16 or older.
- Started gives you small, AI-written steps. They are suggestions. They are not medical advice, and Started does not diagnose or treat anything.
- Started Plus is an optional subscription. It renews by itself until you cancel in your store settings. Apple or Google handles payment and refunds.
- What is free stays free. We add to Plus. We do not take free features away and put them behind it.
- Your tasks are yours and stay on your phone.
1. Who we are and what these terms are
Started is published by Samson Clement, [ADDRESS]. In these terms, "we" and "us" mean Samson Clement. "You" means the person using Started.
These terms are the agreement between you and us for the Started app and Started Plus. By downloading, opening or using Started you agree to them. If you do not agree, please do not use the app. Our Privacy Policy explains how data is handled.
2. Who can use Started
You must be at least 16 years old to use Started. If you are under 16, please do not use it.
3. Your licence and the rules
We give you a personal, non-exclusive, non-transferable licence to use Started on devices you own or control, for your own use. In return, please do not:
- copy, sell, rent or share the app, or take it apart to get at its code, except where the law lets you;
- use it to break the law or other people's rights;
- try to break, overload or get around our relay, our rate limits or the store's billing;
- use the AI features to make content that is illegal, or that harms or harasses others.
4. Not medical, legal or professional advice
Started is made for ADHD brains. It is a productivity tool. It does not diagnose ADHD or any other condition, does not treat, cure or prevent anything, and is not a substitute for a doctor, therapist or other professional. Nothing in the app or on this website is medical advice.
Nothing in Started or on this website is legal, financial, tax or other professional advice either. You use Started at your own judgment. Ask a qualified professional about anything that matters to your health, your money, your legal position or your safety.
Started is not for emergencies. If you or someone else may be in danger, contact your local emergency services or a crisis line straight away.
Started is not a crisis or emergency service, and it cannot call for help for you. If you may harm yourself or someone else, or you are in danger, contact your local emergency services (for example 999 in the UK, 911 in the US or 112 in the EU) or a crisis line now. Do not wait for Started, and do not rely on it for this.
5. AI-written steps
Steps, plans and Tool replies are written by an AI model (see the Privacy Policy for who handles your text). They can be wrong, unsuitable or incomplete. Use your own judgment. Check anything that matters, such as dates, money, medicine, legal or safety questions, before you act on it. We do not promise that a reply will be accurate, or that it will help you finish a task.
You decide what to do with a step, a plan or a reply. You are responsible for what you do, or do not do, because of one. We do not promise that a step is safe, lawful or right for you.
6. Your content
The tasks, notes, photos and other things you put into Started stay yours. We take no ownership of them. You give us permission to pass what you send to our relay on to our AI provider, only to write your reply, as the Privacy Policy describes. You are responsible for what you send. Please do not send anything you have no right to send, or that is unlawful.
The AI's reply is for you. We claim no rights over it either, so far as the law lets us give them up.
7. Started Plus
- What it is. Started Plus is an optional, auto-renewing subscription, monthly or yearly. The app is free to download and use without it.
- Price. The price in your currency is shown by the App Store or Google Play before you subscribe, and again in the store when you confirm. The price in the store is the price you pay, including any tax the store adds.
- Free trial. When a 7-day free trial is offered, it is shown before you subscribe. Trials are for new subscribers, and the store decides who is eligible. Cancel before the trial ends to avoid being charged. Any unused part of a free trial is lost when you subscribe. If notifications are on, Started reminds you the day before a trial ends.
- Payment and renewal. Payment is charged to your Apple ID account (iPhone) or your Google Play account (Android) when you confirm the purchase. The subscription renews automatically for the same period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel. On iPhone: Settings → your name → Subscriptions → Started. On Android: Google Play → your profile picture → Payments & subscriptions → Subscriptions → Started. Deleting the app does not cancel your subscription. After you cancel, Plus stays on until the end of the period you paid for.
- Price changes. If the price of Plus changes, we show the new price in the app before you are charged, and the store asks for your agreement where its rules or the law require it. A price change does not apply until your next renewal after that notice.
- Restore. Use Restore on the Plus screen to bring a purchase back on a new phone, with the same Apple ID or Google account.
8. What stays free
A feature that is free in Started stays free. We will not move it into Plus. We may add new things to the free app, and we may add new things to Plus. If a Plus feature changes, we will say so in the app. If we remove something you paid for, you can cancel, and we will say how to claim a refund from the store.
9. Refunds and your right to cancel
Apple and Google take the payment, so refunds are handled by them under their own rules. Ask through your store: Apple at reportaproblem.apple.com, or Google Play through your order history.
If you live in the UK or the EU: you normally have 14 days to cancel a digital service you have bought. When you subscribe, you ask for Plus to start straight away. You agree that once Plus has started, you lose the 14-day right to withdraw, as the law allows. You can still cancel renewal at any time, and your rights if the service is faulty are not affected (section 12). If you start a free trial, cancel before it ends to avoid being charged. Nothing in this section takes away any refund right the store gives you.
10. Changes to the app and availability
We may update, improve or change Started, and we may fix a feature, or retire one that no longer works. Retiring a free feature does not move it into Plus. We will not promise the app is always on. The AI features need an internet connection and depend on our hosting and AI providers, so they can be slow or unavailable. The core steps work without them. If a change makes Plus clearly worse for what you paid for, tell us at hello@usestarted.com and we will put it right.
Things outside our control, such as a fault at one of our providers, maintenance or your internet connection, can interrupt Started. We may change, limit or stop any feature, and where we can we will tell you in the app first.
11. Ownership
Started, its name, Sam, the design, the text and the code belong to us or our licensors. These terms give you a licence to use the app. They do not give you ownership of any of it. Third-party software in the app is covered by its own licences.
12. Our responsibility to you
Nothing in these terms limits or excludes anything the law does not allow us to limit or exclude. That includes liability for death or personal injury caused by our negligence, for fraud, and your legal rights as a consumer.
If you are a consumer in the UK, digital content and services must be of satisfactory quality, fit for their purpose and as described. If they are not, you may be entitled to a repair or replacement, a price reduction or a refund. Other countries give similar rights, which we respect.
Subject to that, Started is provided as it is. We are not liable for loss that was not a foreseeable result of our breach, for business losses (Started is for personal use), or for results of acting on a suggestion the AI wrote. Our total liability to you for any one claim is limited to the greater of the amount you paid us for Started Plus in the 12 months before the claim and 50 pounds sterling.
As is and as available. To the extent the law allows, Started and its replies are provided "as is" and "as available". We give no warranty or promise that Started will be accurate, complete, error-free, secure, always available or fit for any particular purpose, or that it will give you any particular result. Any warranty or condition the law would otherwise add is excluded so far as the law allows. In some places the law does not allow some of these exclusions, so some of them may not apply to you.
What we are not liable for. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profits, income, savings, data or opportunity, whether the claim is in contract, in tort (including negligence) or otherwise. We are also not liable for what you do, or do not do, because of a step, plan or reply. If you are a consumer, these limits apply only so far as the law allows. None of this limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit, and it does not take away your statutory rights as a consumer.
13. Ending your use
You can stop at any time. Cancel Plus in your store settings and delete the app. You can wipe your data first in You → Data. We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering Started. If we stop offering Plus, we will give notice in the app and not charge you for any period after it ends.
When your use ends, the parts of these terms that are meant to carry on, such as ownership, liability, your responsibilities and disputes, carry on too.
14. Changes to these terms
We may change these terms, for example when we add a feature or the law changes. We will update the date at the top. For a change that matters, we will tell you in the app before it starts. If you do not accept a change, stop using Started and cancel Plus. A change to these terms does not change the price or length of a period you have already paid for.
A change to these terms starts on the date we give. If you keep using Started after it starts, you accept it.
15. If you use Started on iPhone
These terms are between you and us, not Apple. Apple's Standard License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) also applies. If it conflicts with these terms on your iPhone, Apple's agreement wins on the points it covers. In addition:
- We, not Apple, are responsible for Started and what it contains. Apple has no duty to give any maintenance or support for it. Support is at hello@usestarted.com.
- If Started does not meet a warranty that applies, you may tell Apple, and Apple will refund the purchase price of the app (it is free). To the extent the law allows, Apple has no other warranty duty for Started. Other claims, losses and costs are ours to handle.
- We, not Apple, deal with claims about Started, including product liability, legal or regulatory duties, consumer protection claims, and claims that Started infringes someone's intellectual property. If a third party says it does, we, not Apple, investigate, defend and settle it.
- You confirm that you are not in a country under a US government embargo or listed as a restricted party, and that you follow the third-party terms that apply when you use Started.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple can enforce them against you.
- Our name and address are at the top of this page.
16. If you use Started on Android
Your purchase of Started Plus is also under the Google Play Terms of Service. Google handles payment, renewal and refunds for Google Play purchases.
17. Governing law, disputes and courts
These terms and any dispute about them or about Started are governed by the law of England and Wales. The courts of England and Wales can decide any dispute. This does not remove the mandatory rights you have as a consumer under the law of the country where you live, and you may also bring a claim in the courts there.
Talk to us first. If something goes wrong, write to hello@usestarted.com and tell us what happened. We will try to settle it informally with you within 30 days, and we ask you to give us that time before you start a claim. This does not stop you going to court, or to an official or consumer body, where the law gives you that right, or asking a court for urgent protection.
If you live in the United States, to the extent the law allows: (a) you and we each agree to bring claims only on our own behalf, and not as a plaintiff or class member in any class, collective or representative action; and (b) any claim must be started within one year after it arose, or it is barred, where the law allows a period that short. Nothing in this section limits rights you cannot give up under the law where you live.
18. General
- If a part of these terms cannot be enforced, it is limited to what can be enforced, or removed, and the rest still applies.
- If we do not enforce a term straight away, we can still do it later. Giving up a right is valid only if we say so in writing.
- You may not pass these terms to someone else without our consent. We may pass them to a company we set up later, or to one that takes over Started, as long as your rights stay the same.
- These terms and the Privacy Policy are the whole agreement between us about Started. They replace anything said or agreed before about it.
- A person who is not a party to these terms has no right to enforce them, except Apple as stated in section 15.
- If a translation differs, the English version applies.
19. Your responsibilities
You are responsible for how you use Started and for what you do because of it. That includes the content you send, keeping your phone secure and following the laws that apply to you.
To the extent the law allows, you agree to cover our reasonable costs, including reasonable legal fees, from a claim by someone else that comes from your misuse of Started, your breach of these terms, or your breach of the law or of another person's rights. We will tell you about the claim promptly.
If you are a consumer, this applies only to the extent the law allows, only to loss that your misuse or breach caused, and never to loss that we caused.
20. Third-party services
Started relies on services run by others, including Apple, Google, Cloudflare and Anthropic. Their own terms and privacy policies cover what they do, and we do not control them. To the extent the law allows, we are not liable for an outage, delay, change, error or loss in a third party's service, or for what a third party does.
This does not limit our duties to you under section 12 or under the law.
